JOB PURPOSE:

Discipline Counsel (Indigenous Issues) represent the Law Society in legal professional regulatory matters (“Matters”) before the Law Society Tribunal and in the courts but possess a level of knowledge and expertise in Indigenous culture that they can apply when dealing with the prosecutions (“Indigenous Prosecutions”) of Indigenous licensees, and licensees who are the subject of complaints from Indigenous people.  As a result, Discipline Counsel (Indigenous Issues) will specialize in (but not be limited to) the prosecution of Indigenous Prosecutions.

KEY ACCOUNTABILITIES:

Client / Customer Service Delivery

Responsible for preparing cases for hearing, communicating with licensees and their counsel, attending prehearing and proceeding management conferences, communicating with Law Society staff and complainants, and achieving a fair, timely, and efficient regulatory outcome.
Provide advice to members of Litigation and Investigation Services as required.

Policy Development

As directed by their Practice Lead or the Director, Litigation Services, Discipline Counsel are responsible for initiating, researching, and recommending appropriate policy changes related to the improvement of the regulatory process.
Participate on Bencher committees and working groups as requested.

Performance Goals, Targets and Standards

Contribute to and participate in the development of standardized practices, guidelines, and procedures for the prosecution of legal professional regulatory cases; comply with caseload priorities, time lines, and strategies when dealing with their Matters; and work with others in Litigation Services to establish, monitor, and continuously improve processes and case management performance.

Team Membership

Promote the sharing and transfer of knowledge, applicable standards, and information amongst members of the Litigation Services Department and the rest of the Professional Regulation Division.
Work with and share expertise with other regulatory bodies and legal organizations, as directed by their Practice Lead or the Director, Litigation Services.

CredentialsMust be in good standing as the holder of an L.1 licence issued by the Law Society of Ontario.*
Essential SkillsUnderstanding of Indigenous culture, beliefs and values.
Knowledge of the historical and contemporary impacts of colonization on Indigenous communities.
Understanding of the Law Society’s mandate, services, legislation and policies.
Extensive knowledge of investigation and prosecutorial practices.
In-depth knowledge of the rules of evidence, the rules of procedure, and the law concerning privilege and documentary disclosure.
Superior litigation skills.
Superior legal research skills, including internet research.
Ability to analyze and digest complex spoken and written information.
Ability to communicate clearly and persuasively in both spoken and written language in individual and group settings.
Computer literacy, including familiarity with word processing programs, spreadsheets, and Portable Document Format (PDF) related software.
Understanding of the application of information technology preferably in a regulatory / legal environment.
ExperienceA minimum of 7 years' litigation experience with excellent advocacy and negotiation skills, and sound judgment. 
Experience gained in a professional regulation context (legal or otherwise) is advantageous.
May be required to travel locally to attend meetings at licensee’s offices and occasionally, to travel within the province to interview witnesses or attend hearings outside of Toronto.
